These Terms of Use (“Terms”) govern your access to and use of moonstonehq.com and related services (“moonstone”, “we”, “us”), operated from California, USA. By using moonstone you agree to these Terms; if you do not agree, do not use the service.
The service
moonstone provides market data, research, card-recognition tools, and portfolio tracking for the Pokémon trading card market, on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We may modify, suspend, or discontinue any part of the service at any time.
All content on moonstone is informational only and is not financial advice. See the Financial Disclaimer, which is incorporated into these Terms.
Accounts and acceptable use
You are responsible for your account credentials and for all activity under your account. Except where the next section expressly permits it, you agree not to: reach moonstone by automated means, including crawlers, bots, scripts, headless browsers, and scraping tools; bulk-download, copy, or systematically extract the card catalog, prices, population figures, indexes, or any other data set published here; resell, redistribute, sublicense, or republish moonstone data; interfere with or overload the service; reverse-engineer non-public components; or use the service in violation of applicable law.
Portfolio data you store belongs to you. You grant us the limited license needed to store and display it back to you and to compute aggregate, de-identified statistics.
Automated access and the Scan API
moonstone sells a programmatic product, the Scan API, and using it is not a breach of the paragraph above. Calling the documented API endpoints with a valid API key issued to your account, on a plan that is current (the free Sandbox plan included), is permitted automated access. Nothing else changes: a key authorizes calls to the documented endpoints and nothing more. It is not permission to crawl the website, to fetch pages built for browsers, or to reach endpoints we have not documented.
This permission is narrow on purpose. The catalog and the price data are the company's asset, and an API key is a licence to look items up one at a time, not a licence to take the data set. You may use the results inside your own product. You may not resell or redistribute moonstone data as data, and you may not use the API to assemble a copy of the catalog or the price series, or any substantial part of either.
The full rules, covering rate limits, monthly quotas, what you may do with a result, attribution, and the grounds on which a key is suspended or terminated, are in the API Terms and Acceptable Use, which forms part of these Terms. Where that document and this one differ about API use, that document governs. What you are charged for an API plan, and how to cancel it, are in the Billing Terms.
Intellectual property
moonstone's software, design, research articles, indexes, and compilations are protected by copyright and other laws. Our compilation of card records, price series, and computed figures is ours whether you reached it through a web page or through the API, and access to it, paid or free, transfers no ownership in it.
Third-party marks (including Pokémon-related marks) belong to their respective owners and are used only to identify the products discussed; no affiliation or endorsement is implied.
Limitation of liability
To the maximum extent permitted by law: (a) moonstone and its operators, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or trading/collecting losses, arising from or related to your use of the service, even if advised of the possibility; and (b) our total aggregate liability for any claim relating to the service will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us for the service in the twelve months before the claim arose.
Some jurisdictions do not allow certain limitations; where a limitation is not permitted, it applies to the fullest extent permitted.
Indemnification
You agree to indemnify and hold harmless moonstone and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the service or violation of these Terms.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You agree that any dispute arising from these Terms or the service will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction. YOU AND MOONSTONE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT ANY PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS OR REPRESENTATIVE ACTION, to the extent permitted by law.
If any provision of these Terms is held unenforceable, the remainder stays in effect. We may update these Terms; material changes will be reflected by the “Last updated” date, and continued use constitutes acceptance.
